Gwinnett Car Accident Claims the Life of Emmanuel Marrero, Causes Critical Injuries to Carlos Bonilla; Driver Charged with Vehicular Homicide

A motor vehicle occurring last Saturday evening on Hamilton Mill Parkway, near the intersection with Town Manor Court, in Gwinnett County has claimed the life of a Dacula teenager, and caused critical injury to another Dacula teenager. According to news reports, "18-year-old [Jason Polo of] Dacula..was speeding when his [1992 Honda Civic] left Hamilton Mill Parkway and hit a tree on the raised median Saturday evening, killing [18-year-old Emmanuel Marrero] and critically injuring [18-year-old Carlos Bonilla]." Mr. Polo has been "charged with vehicular homicide, serious injury by motor vehicle and reckless driving." Mr. Bonilla remains in critical condition at Gwinnett Medical Center.

Gwinnett County Police.jpgOur law firm has been retained in many car accident cases such as this one to protect the interests of the injured parties. Given Mr. Polo's apparent criminal fault in causing this incident, he may also be held liable in a civil action for the wrongful death of Mr. Marrero and the injuries sustained by Mr. Bonilla. Mr. Marrero's family and Mr. Bonilla may be entitled to hundreds of thousands, if not millions, of dollars. Any recovery, however, may ultimately depend upon the insurance coverage held by Mr. Polo. Because this coverage may be limited, and because of the fact intensive nature of this incident, it is critical that Mr. Bonilla, and the family of Mr. Marrero, act quickly to ensure that insurance coverage is not exhausted. Lawyers for victims will want to conduct an independent investigation into the cause of the accident, and this would need to be done before the scene is altered in any way.

Our personal injury and wrongful death law firm has recovered millions of dollars in Georgia for injured victims and families who have lost a loved one in car accidents such as this one. As such, we know firsthand how difficult and traumatic this experience may be for Mr. Bonilla and the family of Mr. Marrero. We extend our condolences, and offer our legal assistance if needed.

Terry Hammock, 36, William Lewis, 27, and Chad Litton, 31 Killed in Car Accident on Doc Hughes Road; Families May Elect to Bring Wrongful Death Action

Our law firm was saddened learn of a motor vehicle accident occurring last Thursday night which has claimed the lives of three Gwinnett County residents. According to news reports and police statements, Terry Hammock, 36, William Lewis, 27, and Chad Litton, 31, were killed when a 2007 Chevrolet pick-up driven by Mr. Hammock veered off of a roadway and struck a fence and guardrail before coming to rest in a nearby embankment. The vehicle was traveling eastbound on Doc Hughes Road near its intersetion with Beyers Landing Drive when it left the street for unknown reasons. The accident remains under investigation.

Police Vehicle.jpgIf Mr. Hammock is found to have been at fault in causing this accident, the families of Mr. Lewis and Mr. Litton may elect to pursue a civil action for the wrongful deaths of their family member. The victims and their families could potentially recover a substantial sum, but the ultimate recovery is dependent upon the insurance coverage held by Mr. Hammock. Because this insurance coverage may be limited, it is critical that the families of Mr. Lewis and Mr. Litton act quickly to ensure that such coverage is not exhausted.

Our firm has, unfortunately, represented many victims and their families in these types of accidents. We have, too often, seen victims of victims of car accidents such as these go uncompensated simply for a failure to not quickly pursue a civil action against the at fault driver. We hope that the victims and families in this matter do not face similar circumstances. We extend our sympathies to the families of Mr. Hammock, Mr. Lewis, and Litton, and we offer our legal support if needed.

Lynn Martin, 55, Perishes in Motor Scooter Accident; At-Fault Driver Charged with Second Degree Homicide

Our law firm has learned of a tragic accident occurring on Peachtree Road this past Saturday which has claimed the life of an innocent motorcyclist. According to reports, Lynn Martin, 55, was operating her motor scooter on northbound Peachtree Road when she attempted to make a turn into her residence. Per police statements, Karen Voynich, 24, was operating a Toyota 4Runner and failed to stop for Ms. Martin, striking her from behind. Ms. Martin died of injuries sustained in the crash, and, according to police statements, Ms. Voynich has been charged with second-degree homicide and following too closely,

Police Line at Accident Scene.jpgIn addition to the criminal charges that will be pursued against Ms. Voynich, Ms. Martin's family may seek to pursue a civil lawsuit against Ms. Voynich for the wrongful death of their family member. Given our firm's experience in these types of cases, we understand that the pursuit of a civil claim against the at-fault driver is certainly of little priority at this difficult time. It is important, however, that a competent law firm be retained quickly to ensure that any evidence relating to the incident remains preserved and that the family's interests are protected. We have too often seen evidence critical to a civil claim destroyed by adverse parties who take advantage of a grieving family, and we hope that such a circumstance does not occur in this matter.

We extend our sympathies to the family of Ms. Martin, and offer our legal experience if needed.

According to reports, Thomas Haugh, 53, of Suwanee lost his life in an accident occurring on Suwanee Dam Road near North Gwinnett High School on Thursday morning, June 3, 2010. According to police statements, Mr. Haugh was riding a 2007 Kawasaki motorcycle northbound on Suwanee Dam Road when the operator of a southbound 2009 Honda Civic entered his path in an effort to turn into the high school. The Gwinnett police suggest that an initial investigation has determined that the operator of the Honda driver was at-fault, but criminal charges are pending until a more thorough investigation is completed.

Gwinnett County Police.jpgIf the operator of the Honda Civic is found to be criminally at fault in causing this incident, the driver may also be held liable in a civil action for the wrongful death of Mr. Haugh. Mr. Haugh's family is entitled to damages for their loss, and any recovery may ultimately depend upon the insurance coverage held by operator of the Honda Civic. Based upon our firm's experience in these types of cases, we understand that it is critical that the lawyers for Mr. Haugh's family immediately conduct an independent investigation and ensure that any and all evidence, including the vehicles involved, is preserved.

According to reports, Larry Brian Townsend, 30, was operating a 2000 Dodge Avenger on Hog Mountain Road shortly after 7:00 a.m. when he was struck by a Volvo driven by Shakena Daniel, 20. We are saddened to report that Mr. Townsend lost his life as a consequence of injuries sustained in this incident. According to OnlineAthens.com, charges are pending against Ms. Daniel. Other news organizations have reported, however, that the Georgia State Patrol has yet to assign fault in the accident.

GSP Vehicle.jpgIf Ms. Daniel is found to be criminally at fault in causing this incident, she may also be held liable in a civil action for the wrongful death of Mr. Townsend. Pennie Ann Cearfoss, 47, Killed in Cobb County Car Accident, 4 others Injured; Victims and Families Eligible for Millions of Dollars per Atlanta Accident Attorney

Our Atlanta wrongful death law firm has learned of a motor vehicle accident in Cobb County Friday afternoon which claimed the life of Pennie Ann Cearfoss of Dallas, Georgia. According to police reports and witness statements, Ms. Cearfoss was driving a 2004 Chevrolet Blazer on Midway Road in the Powder Springs area when Jeffrey L. House turned his Jeep Comanche in front of the Blazer while making a left hand turn onto Lost Mountain Road. The Blazer collided with Mr. House's vehicle, and then struck a Honda Odyssey driven by Annabelle Cordova, 61, of Powder Springs. After striking the Odyssey, the Blazer overturned. A passenger in Ms. Cearfoss' vehicle, Joshua Cearfoss, 17, was airlifted to Atlanta Medical Center where he was listed in critical condition. Two other passengers in Ms. Cearfoss' vehicle, Justin Cearfoss, 17, and Jeffrey Cearfoss, 25, were taken by ambulance to Atlanta Medical Center, and they are listed in stable condition. Ms. Cordova was taken to WellStar Kennestone Hospital where her injuries were described as of non-life threatening injuries.

Ambulance on Road.jpgCriminal charges, including vehicular homicide, are anticipated to be filed against Mr. House. Because of these criminal charges, Mr. House will most certainly be liable in a civil action for the wrongful death of Ms. Cearfoss and the injures he caused to the other victims. The victims and their families could potentially recover millions of dollars. The ultimate recovery is dependent upon the insurance coverage held by Mr. House and, because the coverage may be limited, it is critical that the family of Ms. Cearfoss, as well as the other victims, act quickly to ensure that insurance coverage is not exhausted.

Our firm has, unfortunately, represented many victims and their families in these types of accidents. We have, too often, seen victims of car accidents such as these go uncompensated simply for a failure to not quickly pursue a civil action against the at fault driver. Motorcyclist, Ronald Starnieri, Killed in Douglas County after Collision with Pickup Truck; Family of Victim May Elect to Pursue Wrongful Death Case Against At-Fault Driver per Atlanta Accident Attorney

Our law firm is saddened to report yet another tragic accident occurring on Atlanta's roadways. A motorcyclist, Ronald Starnieri, 63, was killed yesterday afternoon following a collision with a trailer that became dislodged from a pickup truck. The accident happened near the intersection off Lee Road and Park Avenue in Douglas County, and, according to witnesses, the truck was maneuvering a curved roadway when its trailer came unhitched. Police have charged the driver of the truck, Don Harold Yarbrough, 53, with vehicular homicide, driving under the influence, failure to maintain his lane and failing to secure the trailers load.

In light of the criminal fault of Mr. Harold, Mr. Starnieri's family has the right to pursue a civil lawsuit against Mr. Harold for the wrongful death of their family member. Although it is difficult to assess the value of a lost life, Mr. Starnieri's family family will most definitely be entitled to a significant sum (perhaps millions of dollars). The value of the case will be enhanced by the fact that Mr. Harold was apparently driving while intoxicated, and this circumstance will allow lawyers for the victim's family to pursue a punitive damages award. We hope that Mr. Starnieri's family elects to pursue a case against Mr. Harold, as he deserves the full punishment allowed by the law.

Our law firm has extensive experience in representing families who have suffered the wrongful death of a loved one at the fault of another. Given the complexity and the high value associated with these cases, we understand that it is critical that Mr. Starnieri's family retain a capable law firm that has the capacity and knowledge necessary to vigorously pursue the family's interests. We extend our condolences to Mr. Starnieri's family and offer our assistance in any way.

Atlanta Motorcycle Accident Attorney Obtains over $1 Million for Family in Wrongful Death Case

The family of a man killed while riding a scooter has settled their claim against the at fault party with the assistance of their Atlanta motorcycle accident lawyers. As a personal injury law firm handling wrongful deaths, brain and spinal cord injuries, and other injuries occurring as a consequence of motorcycle accidents, we believe that this was a good result for the family.

Motorcycle Accident.jpgThe wrongful death decedent was killed whole operating his motor scooter on a Georgia Highway in July of 2007. An individual in an automobile cut the decedent off causing a head on collision. The decedent died at the scene as a consequence of massive head trauma. The at fault party tested positive for cocaine shortly after the collision, as well as THC.

In addition to the personal liability of the at fault party, lawyers for the decedent argued that his employer was also liable under the doctrine of respondeat superior. Under this theory of the law, an individual's employer can be liable for the negligent acts of the employee if the negligent acts occur while the employee is acting in furtherance of the employers business at the time of the negligent act.

Atlanta Car Accident Lawyers and Wrongful Death Attorneys Obtain $20 Million Verdict for Clients

Atlanta auto accident attorneys obtained a $20 million dollar verdict for the estate of a 62-year-old man who died when his automobile was hit by a tractor-trailer truck. The verdict was obtained in Clayton County, Georgia, and jurors delivered the verdict after only 3.5 hours of deliberation. This is another big jury award for personal injury lawyers, and the verdict shows that Georgia juries are willing to properly compensate plaintiffs and punish defendants when the circumstances are appropriate.

Auto Accident Scene with Firemen.jpgIn the negligence case, the estate's auto accident attorneys informed the jury that the decedent had been stopped at a red light when his vehicle was crushed by a truck driven by the Defendant. The lawyers argued that the Defendant was negligent in not keeping a proper lookout, in neglecting to keep his vehicle under control, and in travelling too fast for roadway conditions. The jury accepted these arguments and found that the Defendant acted reckless and with a complete disregard for the safety of others on the roadway.

Prior to presenting the case to the jury, the Defendant's insurance company was only willing to offer $1.5 million dollars to settle the case. The estate's lawyers rejected this offer, and instead trusted that the jury would dleiver a verdict that was just and fair.

Steven Naraine, 26, Killed by Apparent Wrong Way Drunk Driver on I-85; Family Eligible to Recover Substantial Dollar Amount in Wrongful Death Lawsuit

Our Atlanta wrongful death law firm has been informed of a tragic accident occurring on southbound I-85 in DeKalb County early this morning. Steven Naraine was legally and lawfully operating his vehicle on the highway when a green BMW entered the roadway at Shallowford Road travelling in the wrong way in a northbound direction. After travelling less than 1/4 of a mile, the driver of the BMW stuck the vehicle driven by Mr. Naraine. Mr. Naraine's vehicle was then struck by two additional vehicles. Mr. Naraine, we are saddened to report, perished as a consequence of this accident. The driver of the BMW was transported to Grady Memorial Hospital where he was listed in serious condition, and the drivers of the two other vehicles were apparently treated and released from local hospitals. DeKalb County Police spokesperson, Officer Jason Gagnon, reported late this morning that the driver of the BMW was "suspected of being under the influence" at the time of the accident.

I-85 Accident.jpgThe conduct of the driver of the BWM was reprehensible, and his actions amount to clear negligence under the laws of Georgia. Mr. Naraine's family will certainly be entitled to a substantial financial recovery, perhaps millions of dollars, for the loss of their loved one. The family will also, almost certainly, be entitled to a punitive damage award for the reckless conduct exhibited by the driver of the BMW. We have recovered millions of dollars for families who have suffered such losses, and, although no figure can be placed on the loss of a life, we hope that this family receives the full compensation allowed by the law. The driver of the BMW deserves to be punished.

This incident is the latest in a string of terrible automobile accidents recently occurring on Atlanta's roadways. Over the last several days, our office has been retained by a number of victims who have suffered disabling injuries sustained in motor vehicle collisions which happened within the last 2 weeks.
