Motorcyle Accidents in Atlanta: Study Finds that Intersection at Peachtree and 14th Street is the Most Dangerous

Motorcycle Accident.bmpAllstate Insurance Company recently released information indicating that the intersection at Peachtree Street and 14th Street is the most dangerous intersection for motorcyclists in Fulton County, Georiga. According to the study, 7 of 18 fatal motorcycle accidents that occured in Fulton County in 2009 occurred at that location. Other intersections in Fulton and Dekalb countied that had high incidents of motorcycle accidents in 2009 include: Barge Road and Campbelltown Roads; Camp Creek Parkway and Welcome All Road; 10th St. and Piedmont Avenue; Bolton Road and Marietta Road; Buford Highway and Peachtree Street; Delmar Lane and Delmoor Court; and, Donald Lee Hollowell Parkway and Eugenia Avenue.

Motorcycle Safety Can Save Lives per Atlanta Motorcyle Accident Attorney

Harleys on Mountain Top Road.jpgAs the weather gets warmer and gas prices get higher, more people choose transportation that has two wheels instead of four.

Motorcycles take less fuel, and many people enjoy riding them. But safety is key to enjoying the ride.

The Georgia Department of Public Safety was awarded a $70,000 grant from the National Highway Traffic Safety Administration to improve motorcycle safety in the state.

The grant will be used for six road checks, the first of which will be March 9 along I-75 in Monroe County. During the same time, law enforcement will conduct checks in Chatham County on I-95.

It is during these road checks that officers often find motorcyclists who don't have the right licenses, police said.

Motorcyclists are supposed to have a Class M license, which requires a motorcycle driving test.

"I think one of the biggest problems around here is the lack of a motorcycle class driver's license, which means you haven't proven you can handle one or that you know the law requirements regarding one," said Lt. Roy Willing¬ham of the Rome Police Department.

Sgt. Greg Beck of the Floyd County Police Department said if motorcyclists do not have the proper license and are caught, they will be cited and possibly taken to jail. The motorcycle will be confiscated, but the driver can get it back once they have the proper license.

Most do comply with driving laws, Beck said. Motorcycle violations usually involve speed and reckless driving, he said.

"There is a small percentage that drive recklessly," Beck said. "Those are the ones we are trying to reach."

Law enforcement officials have been cracking down on motorcyclists in an effort to reduce deaths.

Their efforts appear to be working.

In 2008, 167 motorcyclists were killed in crashes in Georgia, according to statistics from the Department of Public Safety.

That number dropped to 110 last year. So far this year, six motorcyclists have lost their lives in wrecks.

Lt. Col. Mark McDonough, deputy commissioner of the Department of Public Safety, said the department initiated a public education project in 2009 to raise awareness among all drivers of the need to watch for motorcyclists.

The efforts included safety education presentations to school, church and civic groups by Georgia State Troopers as well as media outreach.

Motorcycle Safety Can Save Lives per Atlanta, Georgia Motorcycle Attorney

Harleys on Mountain Top Road.jpgMore than 5,000 people have died in the last ten years victims of motorcycle accidents. In the last week, two separate accidents have cost two area bikers their lives. Last weekend Kim Loveday, 44, of Cleveland was killed when she was sideswiped by an SUV. Charges are pending in this case. Also last week, Jerry Thornton, 48, was killed in a motorcycle accident.

Undoubtedly, with warmer, longer days, more folks will take to the roads on bikes, but according to an expert, there are things you can do to be safe on the roads while on your bike.

"Be aware of your surroundings. Watch for oncoming cars from side streets. And just general safety rules that would apply to all driving," said Wesley Dilbeck, a safety coach for the Cleveland Rider Education Program.

Dilbeck says watching other vehicles on the road could help save your life- so could wearing the right clothes, such as leather or blue jeans.

"In case you were to go down on the pavement, it gives you good protection against road rash," said Dilbeck.

But, that's not the only important thing you should be wearing. Dilbeck says one of the most important ways to keep yourself safe while riding a motorcycle, is to wear a helmet. He says to make sure it's DOT approved and is the right thickness to keep you safe.

According to Dilbeck, it takes more concentration to drive a bike than a car- all the more reason to pay attention to what's going on around you.

"Studies show it takes 900 different actions, reactions to drive a car. Motorcycles are about 2700," Dilbeck said.

Dilbeck has been riding motorcycles since the mid-70's, he and his wife even drove it to Alaska. But, he's never had a wreck. It's proof, he says, that being careful and aware really can keep you safe.

Good News from Memorial Day Weekend; Georgia Car Accident Injuries Decrease from 2009

Atlanta Skyline Downtown Connector.jpgThe Georgia Department of Public Safety is reporting that over the Memorial Day Weekend, four people were killed in car accidents and more than 600 others were injured. While there were a total of 2,547 crashes with 637 injuries, the four fatalities is a record low. In 2009, over 1,000 injuries were reported over Memorial Day weekend, and 16 fatalities occurred. While one lost life is too many, our law firm is glad that the roadways proved to be safer this holiday weekend.

Georgia's Drivers Fall Below National Average for Safe Driving; Rank 32 out of 50 per National Insurance Survey

A recent study by GMAC Insurance confirms what our personal injury law firm has long known...Georgia's roadways are among the most unsafe in the nation. The following article was posted Atlanta Journal Constitution, detailing the results of the GMAC study:

Motor Vehicle Injury.jpgPeach State motorists ranked 32nd in the sixth annual GMAC Insurance survey with a 76.7 score (out of 100) -- below the national average but a significant improvement from a year ago, when Georgia drivers ranked 47th out of the 50 states. Overall the study showed that nearly one in five licensed motorists - roughly 38 million Americans - would fail a written driver's test if taken today.

Kansas drivers ranked first in the nation (82.3 percent average score), with New York motorists coming in last (70 percent average score).

The survey polled 5,202 licensed Americans from 50 states and the District of Columbia. They were administered 20 questions from state Department of Motor Vehicles exams, with additional questions exploring distracting habits, such as texting behind the wheel.

Atlanta Motorcycle Accident Attorney Obtains over $1 Million for Family in Wrongful Death Case

The family of a man killed while riding a scooter has settled their claim against the at fault party with the assistance of their Atlanta motorcycle accident lawyers. An individual in an automobile cut the decedent off causing a head on collision. The decedent died at the scene as a consequence of massive head trauma. The at fault party tested positive for cocaine shortly after the collision, as well as THC.

In addition to the personal liability of the at fault party, lawyers for the decedent argued that his employer was also liable under the doctrine of respondeat superior. Under this theory of the law, an individual's employer can be liable for the negligent acts of the employee if the negligent acts occur while the employee is acting in furtherance of the employers business at the time of the negligent act.

A Cobb County jury, located just outside of Atlanta, Fulton County, Georgia, recently awarded $1.9 million to a teenager who was seriously injured in a motorcycle accident/car accident. The accident occurred when a motor vehicle negligently turned in front of the motorcycle while travelling on a roadway. The driver of the motorcycle could not avoid the collision, and the teenager, who was a passenger, was violently thrown from the bike.

The legal aspects of a Georgia motorcycle accident are not very different from a Georgia car accident, as the same standard of negligence applies. 1,703 Car and Truck Accident Fatalities in Georgia Last Year

Our law firm continues to read through statistics recently released by the Georgia Office of Highway Safety relating to motor vehicle collisions in Georgia. One particularly distressing set of statistics indicate that there were a total of 1,703 traffic related deaths in the state last year. As an Atlanta based car and truck accident law firm representing individuals who have suffered the wrongful death of a family member, these numbers are of interest as they evidence just how dangerous Georgia's roads can be.

Jaws of Life.jpgThe Atlanta metropolitan area far and away accounted for the most car or truck accident fatalities within the state last year. Fulton County had 123 deaths, Gwinnett County 93, DeKalb County 85, and Cobb County 65. Adding these figures together, 1 car or truck accident fatality occurred in one of these counties for every 10 throughout the rest of Georgia. Every county in the state had at least 1 motor vehicle death, with the exception of Clay County, Jenkins County, Lincoln County, Miller County, and Wilcox County.

In reading through the Georgia Office of Highway Safety statistics, our firm was interested to learn about the type of vehicles associated with traffic related deaths in Georgia last year. Of all car or truck related fatalities, 1035 involved a passenger vehicle of some sort, while 511 involved a pickup truck. The most alarming statistic, however, related to the use of seatbelts. Stunningly, 301 the 1703 fatalities involved an occupant who was not wearing a seatbelt at the time of the collision. This accounted for almost 20% of all deaths on Georgia's roadways last year.
