            <title>Motorcyle Accidents in Atlanta: Study Finds that  Intersection at Peachtree and 14th Street is the Most Dangerous</title>

According to the <a href="http://www.ajc.com/news/atlanta/14th-and-peachtree-most-968611.html?cxtype=rss_news_61499">study</a>, 7 of 18 fatal motorcycle accidents that occured in Fulton County in 2009 occurred at that location. Other intersections in Fulton and Dekalb countied that had high incidents of motorcycle accidents in 2009 include: Barge Road and Campbelltown Roads; Camp Creek Parkway and Welcome All Road; 10th St. and Piedmont Avenue; Bolton Road and Marietta Road; Buford Highway and Peachtree Street; Delmar Lane and Delmoor Court; and, Donald Lee Hollowell Parkway and Eugenia Avenue.  </p>]]></description>

            <title>Motorcycle Safety Can Save Lives per Atlanta Motorcyle Accident Attorney</title>

<p><span class="mt-enclosure mt-enclosure-image" style="display: inline;"><img alt="Harleys on Mountain Top Road.jpg" src="http://www.atlanta-injury-lawyers-blog.com/Harleys%20on%20Mountain%20Top%20Road.jpg" width="300" height="200" class="mt-image-left" style="float: left; margin: 0 20px 20px 0;" /></span><em>As the weather gets warmer and gas prices get higher, more people choose transportation that has two wheels instead of four. </p>

<p>Motorcycles take less fuel, and many people enjoy riding them. But safety is key to enjoying the ride.</p>

<p>The Georgia Department of Public Safety was awarded a $70,000 grant from the National Highway Traffic Safety Administration to improve motorcycle safety in the state. </p>

<p>The grant will be used for six road checks, the first of which will be March 9 along I-75 in Monroe County. During the same time, law enforcement will conduct checks in Chatham County on I-95. </p>

<p>It is during these road checks that officers often find motorcyclists who don't have the right licenses, police said. </p>

<p>Motorcyclists are supposed to have a Class M license, which requires a motorcycle driving test.</p>

<p>"I think one of the biggest problems around here is the lack of a motorcycle class driver's license, which means you haven't proven you can handle one or that you know the law requirements regarding one," said Lt. Roy Willing¬ham of the Rome Police Department.</p>

<p>Sgt. Greg Beck of the Floyd County Police Department said if motorcyclists do not have the proper license and are caught, they will be cited and possibly taken to jail. The motorcycle will be confiscated, but the driver can get it back once they have the proper license. </p>

<p>Most do comply with driving laws, Beck said. Motorcycle violations usually involve speed and reckless driving, he said. </p>

<p>"There is a small percentage that drive recklessly," Beck said. "Those are the ones we are trying to reach." </p>

<p>Law enforcement officials have been cracking down on motorcyclists in an effort to reduce deaths. </p>

<p>Their efforts appear to be working. </p>

<p>In 2008, 167 motorcyclists were killed in crashes in Georgia, according to statistics from the Department of Public Safety.</p>

<p>That number dropped to 110 last year. So far this year, six motorcyclists have lost their lives in wrecks. </p>

<p>Lt. Col. Mark McDonough, deputy commissioner of the Department of Public Safety, said the department initiated a public education project in 2009 to raise awareness among all drivers of the need to watch for motorcyclists.  </p>

<p>The efforts included safety education presentations to school, church and civic groups by Georgia State Troopers as well as media outreach. </em></p>

            <title>Driver Alcohol Detection System for Safety (DADSS) Technology Being Developed to Prevent Alcohol-Impaired Drivers from Operating Vehicles</title>
            <description><![CDATA[<p>As <a href="http://www.murraylegal.com">a personal injury law firm </a>that regularly represents Clients who have been injured, or who have lost a loved one, at the fault of an intoxicated driver, we are excited by early reports detailing the development of the Driver Alcohol Detection System for Safety (DADSS).  The following is an article on the technology that was recently posted on the website of the National Highway Traffic Safety Administration:</p>

<p><img alt="DADSS.bmp" src="http://www.atlanta-injury-lawyers-blog.com/DADSS.bmp" width="275" height="183" class="mt-image-left" style="float: left; margin: 0 20px 20px 0;" /><em>Waltham, Mass. -- U.S. Transportation Secretary Ray LaHood and National Highway Traffic Safety Administrator David Strickland today took a first look at new Driver Alcohol Detection System for Safety (DADSS) technology being developed to prevent alcohol-impaired drivers from operating their vehicles while under the influence.</p>

<p>Secretary LaHood and Administrator Strickland were joined by Shane Karr, vice president for Federal Government Affairs at the Alliance of Automobile Manufacturers, and Laura Dean Mooney, national president of Mothers Against Drunk Driving (MADD), and JD Crouch, president of QinetiQ North America's Technology Solutions Group for a demonstration of DADSS technology at the QinetiQ lab where it is under development in Waltham, Mass.</p>

<p>While still in the developmental stages, DADSS is seen as a potential tool for keeping drunk drivers from being able to operate their car if their blood alcohol concentration is at or above the legal intoxication limit (.08 BAC or higher). The technology could be voluntarily installed as an option for new cars. One system under evaluation determines the blood alcohol concentration through a touch-based approach and another system uses a breath-based approach.</p>

<p>NHTSA research shows that drivers involved in fatal accidents with blood alcohol levels above the .08 legal limit are eight times more likely to have had a prior conviction for impaired driving than drivers who had no alcohol in their bodies at the time of a wreck.</p>

<p>"Drunk driving continues to be a national tragedy that needlessly claims the lives of thousands of people on our highways each year," said Secretary LaHood. "We need to put an end to it."</p>

<p>MADD President Laura Dean-Mooney, who was left a widow and single mother when a drunk driver killed her husband, Mike Dean, welcomed the progress of the DADSS research effort, saying, "Auto makers have stepped up to help turn cars into the cure. This project has made substantial progress and this technology could one day be an important step in our efforts to eliminate drunk driving."</p>

<p>DADSS is being developed under a five-year, $10 million cooperative initiative between NHTSA and the Automotive Coalition for Traffic Safety (ACTS), an industry group representing most of the world's auto makers.</p>

<p>"What we're doing is developing technology that won't interfere with sober drivers, will require virtually no maintenance or upkeep and will have such precision that it only stops a driver when their blood alcohol content is .08 BAC or higher, which is the illegal limit for drunk driving in every state," said Shane Karr. "Now that we have actual prototypes, a tremendous feat in itself, we'll be working to identify the gaps in performance between these prototypes and the precise standards we've identified as true technology requirements. This will point the way forward for the next phase of research."</p>

<p>"The technology we are seeing here today could quite simply signal a new frontier in the fight against drunk driving," said NHTSA Administrator Strickland.</p>

<p>The next stage of development, which would include practical demonstrations of one or more of the alcohol detection technologies, could begin later this year.</p>

<p>"Whatever the future holds for these advanced drunk driving prevention technologies, one thing remains clear; no technology can, or should, ever replace a driver's personal responsibility not to drive drunk," the Administrator said.</p>

<p>In 2009, 10,839 people died nationwide in crashes involving a drunk driver. These deaths make up 32 percent of all fatal crashes.</em></p>]]></description>

            <title>Approximately 800,000 Dorel Child-Safety Seats Are Recalled</title>
            <description><![CDATA[<p><a href="http://murraylegal.com">The Murray Law Firm</a> would like to alert our Clients and all parents of a significant child-safety seat recall by the The National Highway Traffic Safety Administration. The child seats were made by the Dorel Juvenile Group and were sold under the brand names Safety 1st, Maxi-Cosi, Cosco and Eddie Bauer. Last year the NHTSA received reports that the restraining straps on the seats had loosened during travel.  Christopher Jensen, The New York Times  02/14/2011<br />
Almost 800,000 child seats are being recalled because their harnesses may not hold the child securely, the National Highway Traffic Safety Administration said Monday.</p>

<p>The recall covers a wide range of booster, convertible and infant seats, including some sold as part of a stroller travel system, made by the Dorel Juvenile Group of Columbus, Ind. The action was prompted by the safety agency, which began an investigation of the restraints last year after receiving several consumer complaints that the restraining straps on the seats had loosened.</p>

<p><em>The restraints were sold under the brand names Safety 1st, Maxi-Cosi, Cosco and Eddie Bauer, Julie Vallese, a Dorel spokeswoman, said in a telephone interview. They were manufactured from May 1, 2008, to April 30, 2009. A list of the affected models can be found here.</p>

<p>In a filing with N.H.T.S.A., Dorel said, "There have been no reports of center front adjuster failure in real world crashes, no injuries and no deaths reported to the company."</p>

<p>Dorel said it had received 143 complaints of the front harness loosening and was conducting the recall even though it feels there was no safety defect. Instead, it told the agency the restraints "exhibited performance issues."</em></em></p>]]></description>

            <title>Georgia Department of Public Safety TACT Program Pushing to Make Highways More Safe by Identifying Dangerous Tractor Trailer Operators</title>
            <description><![CDATA[<p>Our personal injury law firm wishes to recognize the efforts of the Georgia Department of Public Safety's TACT Program.  Among other aims, the program is designed to identify and isolate hazardous tractor trailers and their drivers upon Georgia's roadways.  As a car and truck accident law firm that sees all too many of the accidents caused by these tractor trailers, this program is one that is highly needed. TACT, or Targeting Aggressive Cars and Trucks, combines enforcement and education to increase driver awareness of the dangers associated with risky driving behaviors around commercial motor vehicles.  During the five-day effort, troopers and MCCD officers made 296 contacts that included 123 commercial vehicle inspections, 101 citations, and 72 warnings.  Included in the activity were 11 citations and 22 warnings to drivers of commercial vehicles for following too closely.  Of the 123 inspections, six vehicles and six drivers were placed out of service with inspections revealing 84 equipment violations and 105 driver violations.</em></p>

            <title>Georgia Workers Compensation Claims: What to Do in the Event of a Work Accident</title>
            <description><![CDATA[<p>As Atlanta has increased in size and population, <a href="http://www.murraylegal.com/lawyer-attorney-1078414.html">Atlanta work injuries</a>, Atlanta work accidents, and Atlanta workers compensation claims have so to increased.  The workers compensation system in Georgia is complex, and an injured worker, without proper guidance from an attorney or lawyer, is, in many instances, taken advantage of by his or her employer.  Given this scenario, to assist injured workers, we have prepared a 'to do list' in the event of a work accident.</p>

<p><span class="mt-enclosure mt-enclosure-image" style="display: inline;"><img alt="Construction Injury.jpg" src="http://www.atlanta-injury-lawyers-blog.com/Contsruction%20Injury.jpg" width="300" height="200" class="mt-image-left" style="float: left; margin: 0 20px 20px 0;" /></span>Following a work accident in Georgia, no matter how minor or severe the injury, the most important thing for an injured worker to do is to report the incident to his or her acting supervisor.  Georgia law requires that a work injury be reported to an employer with 30 days of the accident, and failure to do so could allow the employer to deny the workers compensation claim.  As a consequence, do not hesitate in notifying your employer and be certain to indicate how the work accident occurred and the various injuries that were sustained.  After reporting the accident, if you are seriously injured, request that your employer call 911 or transport you to an emergency room for immediate care.  If you are not sure if you are hurt, out of an abundance of caution, seek treatment at an emergency room.</p>

<p>After receiving immediate care for your injuries, you should take pictures of the scene of the work accident.  Employers may attempt to alter the accident scene, so it is important to document exactly what the area looked like at the time of the accident.  If you don't have a camera with you, use your phone to take the pictures.  It is also important to take pictures of your work injury...bruising will disappear within days, so it is critical to preserve the visual severity injury as quickly as possible.</p>

<p>After taking pictures of your injury and the accident scene, you should ask your employer for a panel of physicians.  Georgia law allows an employer to limit the medical providers that an injured work may treat with after a workers compensation accident, but only if the employer properly posts a panel of physicians at its workplace.  If the employer fails to post this panel, which is usually a pink piece of paper posted in the break room, an injured worker is allowed by law to treat with a physician of his or her choice at the expense of the employer.  Also ask your employer who it's workers compensation insurance company is, and the telephone number for the insurance company's claims office.  Make a note of this information for your records.</p>]]></description>

            <title>Cobb County Jury Awards $1.1 Million to a 77-year-old Woman Run Over by Her Own Car</title>
            <description><![CDATA[<p>A 77-year-old woman was awarded $1.1 million by a Cobb County jury for injuries she suffered after being run over by her own vehicle due to a defective gear shift that moved out of the parking position.  The Plaintiff sustained serious injuries which forced her to retire from her job of 30 years.  The jury found that the Jasper Jeep Dodge Chrysler was negligent because the Plaintiff's vehicle had been recalled and the dealer had already performed the recall repairs when the accident occurred.  This is a significant victory for injured victims in Cobb County, as Cobb County juries have a reputation of being very conservative.</p>

            <title>Atlanta Workers Compensation Attorney Provides More Data on Georgia Workers Compensation Fatalities</title>
            <description><![CDATA[<p>We continue to read through new data released by the U.S. Department of Labor relating to work related deaths in Georgia.  As <a href="http://www.murraylegal.com/lawyer-attorney-1078409.html">an Atlanta work injury attorney</a>, this information is of critical importance to us as it indicates in which industries our Clients are most at risk.  The figures also reveal other statistical information, such as the average age of workers in occupational accidents, which assist <a href="http://www.murraylegal.com/index.html">Georgia injury attorneys</a> in determining which Clients are more susceptible to work accidents.</p>

<p><span class="mt-enclosure mt-enclosure-image" style="display: inline;"><img alt="Construction Site Injury.jpg" src="http://www.atlanta-injury-lawyers-blog.com/Construction%20Site%20Injury.jpg" width="300" height="200" class="mt-image-right" style="float: right; margin: 0 0 20px 20px;" /></span><a href="http://www.murraylegal.com/lawyer-attorney-1489815.html">Georgia workers compensation attorneys</a> may be interested to learn that, of the 171 workers compensation deaths in Georgia in 2008, almost one-third (52) involved workers between the ages of 45-54.  This statistical group was followed by 35 fatalities involving Georgia workers ages 35-44, and 30 deaths involving workers ages 25-34.  Interestingly, older workers were just as susceptible to work related deaths in Georgia in 2008, as there were 35 deaths involving workers age 55 and older.</p>

<p>Another interesting data set released by the Department of Labor shows that of the 171 <a href="http://www.murraylegal.com/lawyer-attorney-1076041.html">work deaths in Atlanta</a> and throughout Georgia in 2008, 78 occurred in goods producing industries such as mining, construction, and manufacturing.  Another 78 deaths occurred in service providing industries such as banking, leisure and hospitality, and the transportation.  The remaining fatalities, 15, were related to government work activity, with 5 occurring at the federal level, and 10 at the local level.<br />

            <title>Georgia Injured Workers may have both a Workers Compensation Claim and a Personal Injury Case</title>
            <description><![CDATA[<p>Our law firm was recently hired by a man seeking an <a href="http://www.murraylegal.com/index.html">Atlanta accident attorney</a> to assist him with his <a href="http://www.murraylegal.com/lawyer-attorney-1078412.html">personal injury case</a>.  The man was involved in a <a href="http://www.murraylegal.com/lawyer-attorney-1081130.html">motor vehicle accident</a> while driving his company's truck.  The motor vehicle accident was not his fault, and the man suffered a spine injury as a result of the collision.  He contacted us to assist him in his workers compensation claim against his employer.  When we informed him that Georgia law allowed his attorney to also pursue a personal injury claim against the at fault driver, he was surprised.  Apparently, his employer had told him that <a href="http://www.murraylegal.com/lawyer-attorney-1078414.html">Georgia workers compensation law</a> only allowed him to pursue a workers' comp claim.</p>

The first lesson is, if you are ever involved in a work accident, be immediately skeptical of whatever advice your employer offers you.  Too many times as a Georgia attorney have I seen my workers' compensation Clients misled by an employer whose primary concern is the impact that the work injury will have on its insurance premium.  As we have posted in <a href="http://www.atlanta-injury-lawyers-blog.com/2009/08/georgia-workers-compensation-c.html">prior blogs entries</a>, the victim of a work accident in Georgia in entitled to a number of benefits ranging from medical care to weekly indemnity checks.  The workers compensation system in Georgia is very intricate, and an injured worker should seek the assistance of a qualified Georgia attorney before taking any advice from an employer.</p>

<p>The second lesson is that the workers compensation system is not always the only avenue of redress for an individual hurt in a work accident.  It is true that Georgia law includes a statute that is commonly referred to as the 'exclusive remedy doctrine' which prohibits an injured worker from bringing a personal injury action against its employer.  This statute does not, however, apply where a third party unrelated to the employer is at fault in causing the work accident.  Under such circumstances, the injured worker may also have a personal injury case in addition to the workers compensation claim.  Examples of this would be where a company driver is hurt in a car accident caused by another driver (car accident personal injury case), where a worker is hurt by a faulty machine (products liability claim), or where an injured worker slips and falls or is the victim of a violent crime while on a property not owned or leased by the employer (<a href="http://www.murraylegal.com/lawyer-attorney-1081139.html">premises liability case</a>).</p>
